§ 26-58. Sale of certain property authorized.

  • Excluding prohibited weapons, controlled substances, narcotics, intoxicating beverages and cash, all miscellaneous personal property which has been in the possession and custody of the Laredo Police Department for a period of three (3) months or more and which remains unclaimed, abandoned or unidentified by its rightful owner and which is not being held by the police department as evidence for use in trials and pending cases, and which has not been ordered destroyed or returned to the person entitled to possession of such property by any justice of the peace, county judge or district judge, may be disposed of by local public auction or by internet public auction, as provided in this article. The personal property covered by this ordinance shall be delivered to the officer in charge of the police property section, who is the city's designated property officer for the purposes of this article. The property officer is responsible for the disposition of the property in compliance with this article and state law. Nothing herein shall be construed to prevent the city manager from entering into an agreement with a private entity for the sale of property by local public auction or by internet auction.
