§ 26-61. Required notices.
(a)
Known owner. If the owner is known, the property officer shall mail a notice to the last known address of the owner of such property by certified mail. The notice must describe the property, [and] give the name and business address of the property officer. The notice must advise the owner if the property is not claimed within ninety (90) days from the date of the notice, the property will be disposed of and the proceeds, after deducting reasonable expense of keeping such property and the costs of disposition, and placed in the general fund of the city.
(b)
Owner or owner's address unknown and property has a fair market value of five hundred dollars ($500.00) or more. If the owner or the address of the owner is unknown, the property officer shall cause to be published a notice containing a general description of the property being held, the name and address of the property officer, and a statement that if the owner does not claim the property within (90) days from the date of publication, the property will be sold and the proceeds, after deducting reasonable expense of keeping and disposing of such property, will be placed in the general fund of the city. If the property has a fair market value of less than five hundred dollars ($500.00), and the owner or owner's address is unknown, the property officer may sell or donate the property without having to comply with the provisions of this article.
(c)
Notice to bidders. The property officer shall prepare a public notice containing the time and place of sale of all property subject to sale under this article, containing a brief descriptive list of the property to be offered for sale, names of owners if known, and the date and place (either local or via the internet) sale will occur, and publish one (1) time in a daily newspaper not less than fourteen (14) days prior to the date of sale. Should the property officer conduct the public sale via the internet, the property officer shall comply with this article by including in the required public notice the name of the company that is conducting the sale, the company's web address and a statement that any interested bidders must follow the instructions on the designated website.
