§ 28-4. Fee for temporary lease of a street for private use.

  • In addition to all other regulations governing the temporary closing of a street or portion thereof for its lease to a private party, there shall be charged for the lease of said street, or portion thereof, the sum of one hundred dollars ($100.00) as consideration for the temporary lease of said public property. By "temporary closing" is meant a situation where the street is closed for not more than twenty-four (24) hours. Any closing of a street for temporary leasing to a private party for more than twenty-four (24) hours shall be subject to negotiation as to the appropriate consideration necessary to be paid to the city. Furthermore, by "private party," is meant any individual or group of individuals, whether association, partnership or corporation, except that the term "private party" shall not be deemed to include a church, school or nonprofit organization, whose purpose in temporarily leasing such temporarily closed street is attended by a public or benevolent purpose.
