§ 28-107. Vending under special event vendor's permit; requirements.

  • (a)

    Vending within the city limits at special events organized or recognized by the city shall be permitted only if the vendor obtains a special event vendor's permit for the special event.

    (b)

    A special event vendor must obtain and maintain current applicable licenses and permits from the health department if he is vending goods. Any vendor selling food items which are required to be vendor heated must have a commissary which meets all state and local health requirements. Any such vendor shall be prohibited from selling food products within fifty (50) feet of a food establishment along a parade route.

    (c)

    The vendor must provide the parks and leisure services department a description of the cart or display apparatus, a list of the goods and/or merchandise which the vendor will be selling under the special event permit, and copies of the appropriate health department licenses and/or permits. Upon approval of these items, the parks and leisure services department will issue a special event vendor's permit to the vendor. The special event vendor's permit shall be for a specific date or dates only and the permit shall indicate the following:

    (1)

    Date(s) of event.

    (2)

    Name of the individual who is authorized to vend under the permit.

    (3)

    Name of the organization which the individual is representing.

    (4)

    Items approved for vending.

    The permit shall be nontransferable. The permit must be prominently displayed on the individual who is vending at the special event. The special event vendor's permit fee shall be twenty [dollars] ($20.00) per day, per individual vending.

    (d)

    Under no circumstances shall a vendor with a special event vendor's permit vend in the Central Business District with or from a motorized mobile vehicle. A vendor shall comply with all applicable laws, regulations and ordinances in his vending activities.
