§ 32-105. Rotation list permit basic requirements.

  • All tow services desiring to obtain and maintain a rotation list permit shall meet the following basic requirements:

    (1)

    Generally.

    a.

    All applicants, owners, and partners shall not have been convicted of any theft, felony, assault, any other crime involving the taking, use, tampering with or conversion of a motor vehicle or crime involving violence, within the last five (5) years from date of application.

    b.

    Each tow service, its wreckers and storage facility(s) shall comply with all city, state and federal laws, rules or regulations.

    (2)

    Insurance. All tow services shall have the following insurance:

    a.

    A garage keeper's legal liability policy not less than nine thousand dollars ($9,000.00) for loss or damage to property of others if the tow service's vehicle storage facility has not more than fifty (50) motor vehicles; eighteen thousand dollars ($18,000.00) if the facility has space to store fifty-one (51) to ninety-nine (99) motor vehicles; and twenty-five thousand dollars ($25,000.00) if the facility has space to store one hundred (100) or more motor vehicles;

    b.

    Commercial general (public) liability insurance for combined single limit for bodily injury and property damage in the amount of one million dollars ($1,000,000.00) per occurrence or its equivalent;

    c.

    An automobile liability policy insuring the tow service owner and all his employees for liability for death, bodily injury, or property damage to third parties in the amount of not less than one hundred thousand dollars ($100,000.00) for any one (1) person and three hundred thousand dollars ($300,000.00) for one (1) incident and fifty thousand dollars ($50,000.00) for property damage and each of the tow service's wreckers shall be so covered;

    d.

    Statutory limits of worker's compensation insurance;

    e.

    Such insurance shall be in effect during the period for which the rotation list permit is issued.

    (3)

    Wreckers.

    a.

    All tow services shall have at least four (4) or more light duty wreckers that:

    1.

    Are equipped according to this article;

    2.

    Are registered by the state for each of the wreckers intended to be used by the tow service upon request by the police;

    3.

    Have title; and

    4.

    Have certificates of insurance evidencing coverage on each wrecker and providing year, make, model, state license number, and motor number of each wrecker.

    b.

    If a tow service would like to be on the heavy-duty wrecker rotation list, then it must have at least two (2) heavy-duty wreckers.

    (4)

    Storage facility. All tow services shall have a storage facility that is:

    a.

    Located within the corporate limits of the city;

    b.

    Licensed as a vehicle storage facility by the state department of transportation in accordance with state law;

    c.

    In compliance with the rules and regulations concerning vehicle storage facilities, T.A.C., tit. 43, ch. 18, subch. A and G, as amended;

    d.

    Suitable for protection of stored vehicles;

    e.

    Enclosed by a chain link fence not less than six (6) feet high or equally secure fence or enclosure;

    f.

    Illuminated adequately at night; and

    g.

    Capable of storing or parking twenty-five (25) or more vehicles at any time inside the fenced or enclosed area. For the purposes of this subsection, the term "enclosed" shall mean inside a building.
