§ 32-165. Inspection of initial application.
(a)
Complete initial applications for an annual permit shall be filed with the city manager or authorized representative and processed within thirty (30) days to allow for investigating and fulfillment of all set requirements are met.
(b)
Upon receipt of an application, the city manager shall conduct an investigation concerning public convenience and necessity and other relevant factors, including but not limited to:
(1)
Number of commercial vans presently in operation in the city;
(2)
Public transportation needs of the city and the ability of existing holders to meet these needs more efficiently or effectively;
(3)
Effect of the proposed additional commercial vehicles for hire service on traffic conditions, commercial van driver's working conditions, existing holders and public mass transportation services;
(4)
Character, experience and fiscal responsibility of the applicant; and
(5)
Any other facts the city manager may deem relevant.
(c)
The applicant has the burden of providing that the public convenience and necessity require the proposed commercial vehicles for hire service and that the applicant is qualified and financially able to provide the proposed service.
(d)
Within a reasonable time following the filing of the application, the city manager shall report in writing the findings of fact and recommendation to the city council. The city council shall then hold a public hearing and take action on the following items:
(1)
Consider whether an annual permit shall be granted; and
(2)
If granted issue a permit to the commercial vehicles for hire service.
(3)
Approve fixed routes; and
(4)
Approve appropriate fares.
