§ 33-314. Pesticides, herbicides, and fertilizers.
(a)
Purpose. It is the purpose of this section to reduce pollutants such as pesticides, fertilizers, heavy metals, oxygen demanding substances, and nutrients in the stormwater discharges.
(b)
Prohibitions. No person shall:

Dispose of, discard, store, or transport a pesticide, herbicide, or fertilizer, or a pesticide, herbicide, or fertilizer container, in a manner that allows a harmful quantity of the pesticide, herbicide, or fertilizer to enter the MS4 and/or water bodies.
(c)
Implications. This subsection implies that pesticides, herbicides and fertilizers must be applied responsibly. It is recognized that excess pesticides will migrate into the MS4 even under normal and proper usage. It is the intent of this article to restrict usage of those chemicals in a manner deemed appropriate by their manufacturer and consistent with the Federal Insecticide, Fungicide, Rodenticide Act (FIFRA).
