§ 5-4. Possession, consumption of alcoholic beverages in certain public places.
(a)
Prohibited. It shall be unlawful to possess or to consume alcoholic beverages at any time at any of the following public places within the city:
(1)
Municipal Little League baseball parks, city softball parks and city baseball parks;
(2)
Municipal swimming pools;
(3)
Municipal parking lots;
(4)
Municipal tennis courts;
(5)
Municipal playgrounds;
(6)
The plazas of the city; and
(7)
The entire grounds of the Laredo Civic Center.
(b)
Penalty for violation of section. Any person who violates any provision of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined in a sum not to exceed two hundred dollars ($200.00).
(c)
Exceptions. An exception is made to the above prohibition in the event there may be a public celebration or a public festival or a public occasion held under the auspices of a responsible organized group, and it is sought by such group to allow alcoholic beverages to be used on or at the celebration, festival or occasion in question at one (1) or more of the prohibited locations, in which case a permit must first be obtained by application to the chief of police, which permit shall not be unreasonably withheld, and further provided that such permit shall be specific as to time, place and duration. It is also an exception to this section that alcoholic beverages may be sold at professional sports events for on-premises consumption provided an admission fee is charged and approval is granted by the chief of police and the city manager.
