§ 28-6. Regulating certain commercial activities in R-2 and R-3 zones.
(a)
Unreasonable noise is prohibited in R-2 and R-3 zoned areas. This shall apply to all kinds of unreasonable noise, and specifically to that which is caused by business activities that carry on at late hours at night after 9:00 p.m. and through 7:00 a.m. the next morning.
(b)
Any business establishment performing activities in an R-2 and R-3 zoned residential area which consist of loading, unloading, crating, uncrating, packing or unpacking anything that creates such noise that perturbs the peace of neighbors shall be prohibited from doing such between the hours of 9:00 p.m. and 7:00 a.m. the next morning. Such activities will include the use of large trucks traveling to and from the particular business establishment.
(c)
Any person convicted of violating this section shall be punished by a fine of two hundred dollars ($200.00) for each violation. Any five (5) consecutive violations within a two-month period shall be grounds for the city to consider revocation of any city-issued permits and licenses to operate such business.
