§ 32-143. Definitions.

  • For the purpose of this article, the following words shall have the meanings set forth in this section, except where the context clearly indicates otherwise:

    Annual permit means permission in the form of a written permit granted by the city to any person to operate a commercial vehicles for hire service for one (1) year.

    City manager means the person appointed by the city council pursuant to the City Charter, or the city manager's authorized representative(s).

    Commercial van means a motor vehicle with a rated passenger capacity of fifteen (15) or less, used to transport persons for hire, for compensation that typically operates from private property commercial van stands on regular fixed point-to-point routes out of the incorporated city limits only, but not including ambulances, limousines or special service vehicles regulated by other city ordinances.

    Commercial van driver means any individual duly licensed as a driver by the state, who has registered as a commercial van driver with the city and has received a city commercial van driver's license as required by this article and has been duly employed to drive a commercial van by the holder or a commercial van permit for use of a commercial van.

    Commercial van driver's license means a license issued by the city for the purpose of commercial van driver identification and ordinance administration.

    Commercial vehicles for hire service means a passenger transportation service operated for hire and for compensation that uses commercial vans and includes, but is not limited to, a facility from which the service is operated, commercial vans used in the operation and a person who owns, controls or operates the service.

    Commercial vehicles for hire/motor vehicle means any vehicle, including buses, designed to transport more than 15 passengers, including the driver, operating for compensation or hire within the incorporated city limits, Mexico and other destinations within the continental United States.

    Holder means any person who has a valid annual permit under this article.

    Immediate family is defined as the parents, spouse, children, brother or sister of the deceased permit holder.

    Operating authority means a valid annual permit under this article.

    Passenger means an individual being transported by commercial van other than the driver.

    Private commercial van stand means a business location on private property from which the shuttle van service is operated.

    Street means any street, alley, avenue, boulevard, drive, public way or highway commonly used for the purpose of public travel.
