§ 28-105. Vending under contract with a street vendors permit in the Central Business District; requirements.

  • (a)

    In certain designated areas within the Central Business District, the city may permit a vendor to sell goods, provided that the vendor enters into a contract with the city and obtains the street vendor's permit as hereinafter described.

    (b)

    The city will designate areas within the perimeter of the Jarvis Plaza Park, the Tatangelo Park walkway, west-side access to bridge #2, Villa Antigua, San Agustin Plaza, Iturbide at Convent, Victoria at Convent (city hall), El Portal south access, El Portal parking lot, Bruni Plaza, Farragut at Flores, Lincoln at Convent, Hidalgo at Convent and the Riverfront Park, which areas shall be the only ones within the Central Business district where goods may be sold. In this connection, the perimeter of such designated areas shall mean from the inside of one sidewalk to the inside of the opposite sidewalk.

    (c)

    For a permit under this category, the city shall contract with one (1) vendor only for each of the designated areas listed above. Under such contract, a vendor shall be allowed to operate not more than one (1) cart at the Jarvis Plaza Park, one (1) cart at the Tatangelo Walkway Park one (1) cart at the west-side access to bridge #2, one (1) cart at the Villa Antigua, one (1) cart at the San Agustin Plaza, one (1) cart at Iturbide at Convent, one (1) cart at El Portal south access, one (1) cart at El Portal parking lot, one (1) cart at Victoria at Convent (city hall), one (1) cart at the Bruni Plaza, one (1) cart at Farragut at Flores, one (1) cart at Lincoln at Convent, one (1) cart at Hidalgo at Convent and four (4) carts at the Riverfront Park. A separate contract shall be entered into for exclusive vending rights at each park, and the term of such contract shall be two (2) years. Each contract shall be awarded on the basis of competitive bids. Unless no other bids are received, no vender shall have the exclusive vending rights to more than two (2) parks at any one time.

    (d)

    In addition to the bid amount to be paid to the city for the exclusive vending rights contract, the vendor must obtain a street vendor's permit in the amount of one hundred dollars ($100.00) per year and must comply with all applicable requirements of this article. This permit must be prominently displayed on the vending cart. The permit is not transferable.

    (e)

    Vending under this provision shall be exclusively from approved carts and in the designated areas. No vending shall be permitted upon the sidewalks and streets during the time the vendor is traveling to or from the designated area under contract.

    (f)

    Any violation of the terms of the awarded contract or of the specific terms of this section may be grounds for revoking the vendor's permit and canceling the contract.
