§ 28-106. Vending under street vendor's permit outside of the Central Business District; requirements.

  • (a)

    The city may issue a permit to a vendor to sell goods from a motorized mobile vehicle or an approved cart under this section. Such a permit will give the vendor the privilege of vending from such a vehicle over city streets, provided that no stop for displays or sales shall be longer than ten (10) minutes at any one place. After any stop for displays or sales of ten (10) minutes, the vendor must proceed a distance of not less than two hundred fifty (250) feet before another stop for another sale. All stops for display or sale must be for ten (10) minutes or less. Vendors cannot operate, play music, or loud sounds between the following hours: Sunday through Thursday 10:00 p.m. to 7:00 a.m. and Friday through Saturday 11:00 p.m. to 7:00 a.m. The vehicle shall not be permitted to vend while parked nor to obstruct traffic, nor shall any sale be made within six hundred (600) feet of the property line of any school, public recreational facility, park or special event unless the vendor has complied with the requirements of section 28-107.

    (b)

    The vendor must obtain and maintain current applicable licenses and permits from the health department in order to vend goods. In addition, the vendor shall obtain a street vendor's permit at the health department. The fee for the permit shall be one hundred dollars ($100.00) and the permit shall be for a period of one (1) year. The permit is not transferable.

    (c)

    In no event shall a street vendor vend from a motorized vehicle within the Central Business District.

    (d)

    The city will designate areas of the Santa Maria at Zaragoza (city parking lot), St. Peter's Plaza, health department, civic center grounds, Father McNaboe Park, where approved food products my be sold in the perimeter of such designated areas, provided that there is no city-sponsored or other organized event.

    (e)

    For a permit under this category, the city shall contract with one (1) vendor only for each designated area listed above. Under such contract, a vendor shall be allowed to operate no more than one (1) cart per designated area. A separate contract shall be entered into for the limited exclusive rights at each designated area, and the term of such contract shall be up to a period of two (2) years. Each contract shall be awarded on the basis of competitive bids. Unless no other bids are received, no vendor shall have the exclusive vending rights to more than two (2) designated areas at any one time.
