§ 5-3. Beer sales near schools, churches and hospitals.
(a)
It shall be unlawful for any person to sell or engage in the business of selling any alcoholic beverage for consumption on the premises where sold, within the corporate limits of the city where the place of business of such person is situated within three hundred (300) feet of any church, public school, or public hospital, the measurements to be along the property lines of the street fronts, and from front door to front door, and in a direct line across intersections wherever they occur.
(b)
This section shall not apply to a location on which there is a business duly licensed by the state alcoholic beverage commission for the selling of beer, for consumption on the premises where sold, which business was in operation prior to May 17, 1966 or prior to the establishment of any church, public school, or public hospital.
(c)
This section shall not apply to a location on which there is a business duly licensed by the state alcoholic beverage commission for the selling of alcoholic beverages other than beer, for consumption on the premises where sold, which business was in operation prior to the date of adoption of this Code or prior to the establishment of any church, public school or public hospital.
