§ 28-102. Definitions.

  • The following terms shall have the following meanings under this article:

    Cart: A cart manufactured for the purpose of vending, constructed of metal and/or wood with a finished surface, and approved by the city parks and leisure services director and, if applicable, by the health department for vending. Shopping carts, dollies, toy wagons, and other such makeshift devices are expressly excepted from this definition.

    Central business district: That area zoned B-2 under the zoning ordinances of the city.

    City food license: Yearly permit extended to a food establishment by the city allowing it to sell approved food products within the city limits.

    Contract for vending in the central business district: A contract between the city and a vendor for the privilege of selling authorized goods upon certain designated public property within the central business district of the city awarded under section 28-105.

    Goods: Vending items that may be sold under a street vendor's permit or a special event vendor's permit which are limited to sealed, prepackaged food items and "raspas" and which have been approved for sale by the appropriate authorities as set out in this chapter.

    Health department: The city's health department, its staff and its authorized agents.

    Merchandise: Tangible property, products or items which are approved by the parks and leisure services department for vending at a special event; these include but are not limited to balloons, toys, handicrafts and buttons.

    Motorized vehicle: A motorized, mobile vehicle that is properly registered and licensed by the state and which has appropriate liability insurance and a valid state inspection sticker.

    Parks and leisure services department: The city's parks and leisure services department, its staff and its authorized agents.

    Special event: An event that is registered with and recognized by the parks and leisure services department, that has a specific location, purpose, and beginning and ending time and date. A special event includes sporting events, cultural events, festivals, carnivals, fairs, parades, etc.

    Special event vendor's permit: A license issued to vendors by the parks and leisure services department to sell goods or merchandise on public streets, sidewalks and other public places during a special event and issued under section 28-107.

    Street vendor's permit: A license to sell goods on public streets, public sidewalks, or other public places issued to vendors by the health department under section 28-106.

    Street performance: Any theatrical, musical, visual, or other similarly artistic presentation for public entertainment purposes where donations from the public are solicited or encouraged. The definition of street performance includes, but is not limited to, musical performances, dances, mime, juggling, and magic shows.

    Street performer: Any person or group of persons who conducts a street performance, including, but not limited to, musicians, dancers, mimes, jugglers, clowns, comedians, and magicians. A street performer engaged in a street performance on a public sidewalk shall not obstruct the traffic of pedestrians and must provide a minimum clear width of thirty six (36) inches of contiguous sidewalk for pedestrian passage.

    Vend: To expose for sale or to sell, peddle or offer to sell any goods or merchandise upon any public sidewalks, streets or other public places or any portions thereof.

    Vendor: A person, individual, partnership, company or corporation, and/or agent or employee of same engaged in vending goods or merchandise under a street vendor's permit or a special event vendor's permit within the city.
